Atom Jobs Terms of Use for Partners
By using Joblet, a service of The Plant Co. Ltd., you are agreeing to the following terms of use ("Atom Jobs Terms of Use").
1 Applying to Atom Jobs
1. You shall complete an application by sending us certain information we designate by a means we specify.
2. Please note that we may reject your application if we determine (in our sole discretion) that your site is unsuitable for Atom Jobs. Unsuitable sites include, but are not limited to, those that:
- promote sexually explicit materials
- promote violence
- promote discrimination based on race, sex, religion, nationality, disability, sexual orientation, or age
- promote illegal activities
- otherwise violate intellectual property rights
2 Prohibited Uses
1. You are prohibited to take any of the following actions: (a) infringing on another’s or our copyrights, trademarks, or any other intellectual properties, (b) infringing on another’s rights such as a third party’s or our properties, privacy and honor, (c) providing false information, (d) putting either us or a third party at a disadvantage, (e) being offensive to public order and morals, (f) breaking laws or taking actions witch may break the laws, ordinances, rules, regulations and orders, (g) using the Atom Jobs service for the purpose of selling or providing information for business purposes, (h) copying, selling or publishing information you obtained through the Atom Jobs, or using information for anything beyond the private use, (i) disrupting operation of the Atom Jobs service or actions which may cause this.
3 Candidate Referral Fees
1. We will pay you, in accordance with this Terms of Use, referral fees on certain job applicants referred from your site.
2. To be eligible for an applicant referral fee, an applicant should click through your site and apply for a job within a session. A session ends upon one of the following events: (a) 24 hours elapses from the applicant's initial click-through, (b) the applicant follows a third party's link to the Atom Jobs.
3. Referral fees are paid for eligible applicants after the job posting company has verified that the applicant meets the minimum qualifications for the position and Atom Jobs has received payment for the applicant.
4 Company Referral Fees
1. We will pay you, in accordance with this Terms of Use, a commission for certain companies you have referred.
2. To be eligible for a company referral fee, a company should click on a link that is specially encoded with your Referrer URL and sign up within a session. A session ends upon one of the following events: (a) 24 hours elapses from the applicant's initial click-through, (b) the applicant follows a third party's link to the Atom Jobs.
3. Referral fees are paid as a percentage of the total earnings generated from companies you have referred.
4. Existing Atom Jobs clients are not eligible. For example, if Company X is already a Atom Jobs client, another account created for the same company is not eligible for any referral earnings or benefits.
5 Payment Schedule
1. We pay you referral earnings on a quarterly basis. Payments are made according to the following schedule:

| 3 | July - September | October 15 |
| 4 | October - December | January 15 |
When the 15th is a bank holiday, payments will be made on the following business day.
2. Payments will be held until the following quarter for referral fees under ¥10,000.
3. We either (a) directly deposit the referral fees earned into your bank account (if you want us to use this method of payment, please note that you will have to provide us with the name of your bank, the bank account type, the account number and the primary account holder name as it appears on the bank account), or (b) pay you via PayPal. You bear any additional handling fees which may occur through these payments.
4. Referral earnings are calculated based on revenues received from companies in the payment period.
6 Subject to Change
Partners agree that payment policies are subject to change.
7 Partners’ Limitation of Liability
Partners use the Atom Jobs at their own risk. Partners, however, won’t be held responsible for any disputes between job posting companies, applicants or other third parties relating to Atom Jobs and will stand out the disputes.
8 Limitations of Atom Jobs's Responsibility
1. We are not responsible for any noneconomic damages or economic damages users might incur from applying to the service or using the service.
2. We are not responsible for problems by caused by any extraordinary event or circumstance beyond our control such as viruses, hardware or software failure, or any other such force majeure.
3. We don’t ensure the accuracy of information provided about or by third parties such as job posting companies, contents of job advertisements or other information provided by job posting companies or any third parties on Atom Jobs.
9 Language of the Terms
If there is any contradiction between the Japanese language version of the Terms and the English language version of the Terms, then the Japanese language version shall take precedence.
